Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Texas Well Exam Prep (the “Service”), operated by AB Morgan Ventures LLC, a Texas limited liability company, doing business as Texas Well Exam Prep (“we,” “us,” or “our”). By creating an account or purchasing access, you agree to these Terms.

1. What we provide

The Service provides online study guides, practice questions, and answer keys intended to help you prepare for Texas Department of Licensing and Regulation (TDLR) water well driller and pump installer licensing examinations.

We are an independent provider. We are not affiliated with, endorsed by, sponsored by, or approved by TDLR, PSI Services LLC, or any government agency. We do not administer licensing examinations and we cannot issue, influence, or expedite any license.

2. No guarantee of results

We do not guarantee that you will pass any examination or obtain any license. Examination content, scoring, and requirements are controlled entirely by TDLR and its testing vendor and may change without notice. Your results depend on your own preparation and performance.

3. Accuracy of content and your duty to verify

Our material cites the sources it is drawn from, including 16 Texas Administrative Code Chapter 76, the Texas Occupations Code, OSHA standards, and published industry references. Rules and standards are amended over time and citations may become outdated.

The Service is a study aid, not legal or professional advice. You are responsible for verifying any rule, figure, or citation against the current official source before relying on it in practice or on an examination.

4. Accounts

You must provide a valid email address and keep your account secure. Accounts are for a single individual. You may not share your account, sign-in link, or access with any other person. We may suspend or terminate accounts we reasonably believe are being shared or used by multiple people.

5. Purchases and access period

Access is sold either per exam track or as a bundle covering all tracks. Unless stated otherwise at the time of purchase, access lasts 365 days from the date of purchase, after which it expires automatically.

Purchasing grants you a limited, personal, non-exclusive, non-transferable license to access the material for your own exam preparation during the access period. You are not purchasing the content itself, and no ownership transfers to you.

If you renew before your access expires, the new period is added to the time remaining. Prices may change, but a change never affects access you have already purchased.

6. Payments

Payments are processed by Stripe. We do not receive or store your full card details. Your use of the payment process is also subject to Stripe’s terms and privacy policy. All prices are in U.S. dollars.

7. Refunds

See our Refund Policy, which is incorporated into these Terms.

8. Acceptable use

You agree that you will not:

• share, resell, sublicense, publish, or redistribute any part of the material;
• copy, scrape, screenshot, or reproduce the material in bulk, or use automated tools to extract it;
• share your account credentials or sign-in link with anyone;
• use the material to build or train a competing product, service, or machine learning model; or
• attempt to interfere with, probe, or gain unauthorized access to the Service.

We may suspend or terminate access, without refund, for a material breach of this section.

9. Intellectual property

All study guides, practice questions, explanations, and site content are our property or used with permission, and are protected by copyright. Statutes, rules, and government publications that we cite remain in the public domain; our selection, wording, arrangement, and explanations do not.

10. Examination confidentiality

Our material is written from published sources. We do not reproduce actual examination questions. If you have taken a licensing examination, you are bound by your own agreement with the testing vendor, and you must not send us actual examination content. We will not accept or publish it.

11. Availability

We aim to keep the Service available but do not guarantee uninterrupted access. We may modify, update, or discontinue features. If we permanently discontinue the Service while you hold paid access, we will provide a pro-rated refund for the unused portion of your access period.

12. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITY, EXAM FEES, OR LOST INCOME, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

14. Indemnification

You agree to indemnify and hold us harmless from any claim arising out of your misuse of the Service or your violation of these Terms or applicable law.

15. Changes to these Terms

We may update these Terms. Material changes will be posted here with an updated date. Continued use after a change means you accept the revised Terms.

16. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Venue for any dispute lies in Brazos County, Texas.
